In the court opinion it states that his deportation was ordered but temporarily “withheld” because his mother had a home-based cooking business (papusas) and was being extorted for regular payments by a gang in El Salvador. The gang also threatened the rest of the family including the now deported gangster. The extortion gang has since been detained in El Salvador’s gangster prison, so that threat no longer exists and the withholding order is now mooted.
The “due process” the leftists are demanding would be to bring the gangster back for an administrative hearing at which the judge would make the finding and order that the deportee be redeported. It’s all a procedural circus with an inevitable outcome. This is just a game by the left to depict orange man as a lawless dictator in the obliging media.

As subjects of foreign governments, visitors here (both legal and illegal) are not automatically granted Constitutional rights. Also keep in mind that there are FAR more "undocumented migrants" in the country than the 11 million which the legacy media admits to -- some estimates are 50-60 million. Having hearings for even a few million of them is impractical.

Enough to overturn the court ruling that said he is not to be deported. That was never overturned, or even allowed to be adjudicated, in court--the court rulings were just ignored and he was shipped out to El Salvador.
If the legal process can be ignored in his case, it can be ignored in yours. There's nothing in the constitution saying "you can just ignore the legal process entirely in the case of X"--indeed, the whole point of the document is that no one, not even the Chief Executive, can do that. And that includes following the legal process as it pertains to deportation and the status of legal non-citizens.
You all do realize that in 2022, he was stopped by a Tennessee State Trooper while driving an SUV owned by an admitted human trafficker, right? He had 8 individuals in the car. He was even granted his right to appeal, however, the appeal ended up being denied.
At the time he was sent to El Salvador, he had still been granted 'withholding of removal status' by the courts, explicitly prohibiting his deportation. If you want to argue his status should be changed, fine, but that argument must be adjudicated by the court, which includes providing him the chance to dispute your argument in court. Instead the whole legal process was ignored and he was deported without having his day in court. Then the administration said "we can't do anything about it because it's foreign policy now." There's no reason the same trick couldn't be pulled on an American citizen. "Oopsie did we send [citizen we don't like] off without a hearing? Well too bad they're in El Salvador now so it's a matter of foreign policy, courts can't tell the prez what to do there, due process can suck it."

Abrego Garcia had a deportation order levied against him by a district judge in 2019. That order was not acted on until March 2025. It was the government of El Salvador that has deemed him to be a gang member and incarcerated him. The case is no longer under US jurisdiction.
Plus: his wife filed two charges of domestic violence against him. And we know that since we are supposed to "believe all women," he's guilty, no trial or jury needed, right? Don't recall the "Me Too" movement being too concerned about Due Process for men back in the day, why all the concern now?

He was found to be in the country illegally (and the same courts found he was MS-13) but then a hold order was applied against him being deported to El Salvador specifically. He can legally be deported anywhere else. He can’t be deported to El Salvador (only) until the issues (his safety there) are resolved, for which purpose the hold order was issued.

I stopped reading when I saw the bogus take on the Abrego Garcia situation. I'm surprised you didn't call him "Maryland father" like the rest of the corporate media.
Others have mentioned the details, but to recap:
1) He was in the country illegally
2) he had a deportation order against him, upheld on appeal
3) the judge found him to be an MS-13 member, also confirmed on appeal
4) he applied for asylum, and was denied
5) his wife filed for a protective order against him for beating her up
6) he had a temporary stay on the deportation to El Salvador due to "safety concerns".
The only thing the Trump admin did wrong was miss giving him an interview to determine that El Salvador is no longer a gang-ridden hellhole and vacate the temporary stay. So now, we're supposed to twist Bukele's arm to have El Salvador send an El Salvadoran MS-13 member to the US so we can cross some Ts, dot some Is, and send him right back? This is what Dems are freaking out about?

That was poorly stated on my part. The correct term would be "harmless error" -- as in a trial, an appeals court may determine that errors were made in the original trial, but the defendant would've been convicted anyway, and thus decline to overturn the verdict.
So they missed the 30 minute interview to determine that his life would not be in danger from the rival Guatemalan gang in the El Salvador of today. He would've been deported just the same. Harmless error.

In the court opinion it states that his deportation was ordered but temporarily “withheld” because his mother had a home-based cooking business (papusas) and was being extorted for regular payments by a gang in El Salvador. The gang also threatened the rest of the family including the now deported gangster. The extortion gang has since been detained in El Salvador’s gangster prison, so that threat no longer exists and the withholding order is now mooted.
The “due process” the leftists are demanding would be to bring the gangster back for an administrative hearing at which the judge would make the finding and order that the deportee be redeported. In the case of deportations due process is not necessary, practical, or warranted. As subjects of foreign governments, visitors here (both legal and illegal) are not automatically granted Constitutional rights. Also keep in mind that there are FAR more "undocumented migrants" in the country than the 11 million which the legacy media admits to -- some estimates are 50-60 million. Having hearings for even a few million of them is impractical.

There's nothing in the constitution saying "you can just ignore the legal process entirely in the case of X"--indeed, the whole point of the document is that no one, not even the Chief Executive, can do that. At the time he was sent to El Salvador, he had still been granted 'withholding of removal status' by the courts, explicitly prohibiting his deportation. If you want to argue his status should be changed, fine, but that argument must be adjudicated by the court, which includes providing him the chance to dispute your argument in court. Instead the whole legal process was ignored and he was deported without having his day in court. Then the administration said "we can't do anything about it because it's foreign policy now." There's no reason the same trick couldn't be pulled on an American citizen. "Oopsie did we send [citizen we don't like] off without a hearing? Well too bad they're in El Salvador now so it's a matter of foreign policy, courts can't tell the prez what to do there, due process can suck it."

He was found to be in the country illegally (and the same courts found he was MS-13) but then a hold order was applied against him being deported to El Salvador specifically. He can legally be deported anywhere else. He can’t be deported to El Salvador (only) until the issues (his safety there) are resolved, for which purpose the hold order was issued.

I stopped reading when I saw the bogus take on the Abrego Garcia situation. I'm surprised you didn't call him "Maryland father" like the rest of the corporate media.

4) he applied for asylum, and was denied

6) he had a temporary stay on the deportation to El Salvador due to "safety concerns".

That was poorly stated on my part. The correct term would be "harmless error" -- as in a trial, an appeals court may determine that errors were made in the original trial, but the defendant would've been convicted anyway, and thus decline to overturn the verdict.
So they missed the 30 minute interview to determine that his life would not be in danger from the rival Guatemalan gang in the El Salvador of today. He would've been deported just the same. Harmless error.

I too am questioning the balance in the reporting here now. A longer quote about how Musk was not elected was displayed but then they failed to counter quote with the most eloquent available response by Stephen Miller. I’m not willing to go that far, but Matt’s take on this case is clearly heavily influenced by his zealous (in this case, overzealous imo) beliefs in constitutional protections and free speech advocacy. I do NOT believe MY rights and protections as a CITIZEN should be no better nor worse than the rights and protections afforded one who is NOT a citizen, nor that the deportation of one here illegally somehow translates into my need to fear similar deportation. I AM however coming to realize Biden (correction: whoever was running our country during the last administration) had a secondary plan when they let in millions of unvetted illegals: If they lost the 2024 election they would use the campaign promise to deport same as a way to clog up Trump 2.0.
I must say, the Democrat party’s ability to callously use entire cohorts of humans (immigrants, the homeless and mentally unstable) as chess pieces is unparalleled…

This writer doesn’t like a lot of what Matt says, but in fact did and will again pick up arms (USMC Infantry) to defend all of our constitutional rights particularly to free speech. Yes, this modestly lazy reader missed the byline, but in essence, you caught the drift. One has to admit the amazing transformation taking place with Matt. He came here illegally and was, yes, granted temporary status, which can be revoked, and was. The Biden Administration granted temporary status to millions who flaunted our laws. If we apply your logic across the board, then those 10m or so that crossed illegally under Biden now become residents, we have 10m separate hearings (then appeals), and our border and laws become a mockery. Voters have rejected this approach, and polls continue to do so, including a majority of every major political party and ethnicity.
Yeah all he was granted was a temporary stay of deportation, only in respect of El Salvador, while they assessed the claimed risk. He is not and never has been here legally. He was just at a pause in his deportation process.

But the CCP has proclaimed that the Chinese will gladly eat grass for a year, the CCP is censoring and pumping out propaganda about how America is the one suffering. The hidden wealth of CCP members, Xi, and their families is being exposed, and resentment could lead to protests. Trump’s revised covid.gov website incriminates Xi as a criminal against humanity, which would add to the loss of faith he’s experiencing with his top brass. They have built up a huge war machine, but there are questions about whether they could execute war plans. It’s been 75 years since China was at war and are young Chinese men willing to fight for a country oppressed with social credits and camera surveillance?
On the flip side, the CCP has spies all over America, they are hacking government communications, and who knows how they could have booby trapped infastructure. This scares me more than losing money. I don’t underestimate the evil of the CCP and its lust for power.

They have very focused strategies around IT theft, developing their industry and military, energy independence, establishing naval bases worldwide, securing key minerals, and disrupting alliances. The West allows massive immigration and argues about DEI, transgender issues and climate change. If you came down from Mars and observed all this, who do you think is more likely to prevail?
